PUBLIC HEARING;
Mr Masinda called the meeting to order at 7:42. File #ZBA 2007-01 – Application for a variance for Zoning regulation Section 4.04.01 and 4.04.02 for existing house and Section 4.04.02 for a new lot.
Lee and Elizabeth Florian were in attendance at the hearing, and several abutters.
Discussion: Ed Pelletier from Datum Engineering and Surveying talking about, amending the Application to add section 4.19 which requires a septic system be 75’ from wetland. They are asking the zoning board of appeal to give them relief of 25’ from the regulation.
Mr. Masinda will check with council to see if they have the authority to grant this relief for the regulation.
Mr. Masinda asked what is the hardship. Answer was they felt it had to do with the uniqueness of the land and the topographic feature found in Ct.
The lot that the existing house is on meets the build able square but not the total 2 acres of build able land. The other parcel meet the 2 acres of build able land but not the dimensional requirements.
Mr. Masinda asked if there was anyone present either for or against the application that would like to speak.
Evelyn Parizek spoke in favor of the change if it meets the wetland regulation.
Chris, as an abutter I do not have any objections.
Arthur Mitchell said his only concern is was something going into the water way.
Donald Parize said if meet the requirement he is not apposed to it
Butch and Tracy Litel said if it does not affect future property they would have no problem with the change.
Mr. Masinda asks to have the hearing continued to next month and to have a site walk done.
Motion made by Norman Wilson to continue public hearing to April 12, 2007 .Seconded by Mr. Mahoney All in favor
Regular meeting called to order at 8:19
Mr. Masinda presented the minutes of December 14, 2006 meeting. And asked if any member had any correction. Richard Maloney made a motion to approve Norman Wilson seconded. All in favor.

Richard Mahoney made a motion to adjourn Norman Wilson seconded, adjourned at 8:35.
